Minnesota recently amended its Consumable Protections Act, which adds cannabis and other hemp-related products to the list of protected consumables. Under the act, employers cannot refuse to hire or discharge an employee based on lawful, off-duty consumption of consumable products. For a full view of the changed law, employers can view it here.
More states are beginning to legalize cannabis and protect employee’s lawful use of the substance. Maryland also recently legalized recreational cannabis, although it has not added some of the employee protections that other states have. Employers of all states should keep an eye out, as even if their state has not legalized marijuana, they are likely to follow suit, sooner or later.
