DHS Reminds Employers to Monitor E-Verify Status Changes

The US Department of Homeland Security (DHS) has announced that:

effective immediately E-Verify will no longer send automatic alerts when an Employee Authorization Document (EAD) for a current employee has been revoked. Instead, employers are now expected to regularly use E-Verify’s new Status Change Report feature to check for any updates and take action when needed.


This change follows the recent termination of humanitarian parole and Temporary Protected Status (TPS) for certain groups. Work authorization for affected employees may be revoked even if their EAD card still appears valid, so regular monitoring is critical to avoid compliance issues and fines.


If an employee shows up on a Status Change Report, employers must complete Form I-9, Supplement B, to reverify their authorization within a reasonable amount of time. If they cannot provide valid documents, employment must be terminated.


Important:

E-Verify users now have an affirmative obligation to run and review this report regularly. Failing to do so may be seen by DHS as knowingly employing unauthorized workers.

Penalties can be steep, with fines ranging from $716 to $5,724 per employee for a first offense.
