Maryland Employment Law Updates and Changes 2026

Effective Date: October 1, 2026 (law) November 1, 2026 (notice requirement)
Maryland has enacted several employment law changes expanding employee protections related to workplace communications and restrictive covenants.
Captive Audience Meetings
Beginning October 1, 2026, employers may not take or threaten adverse employment action against an employee who refuses to attend, participate in, or listen to employer-sponsored communications expressing the employer's views on political or religious matters. The law defines political matters to include issues related to an employee's decision to join or support a labor organization.
Beginning November 1, 2026, employers must also make available the official poster and model notice issued by the Maryland Commissioner of Labor and Industry explaining employees' rights under the law.
Noncompete Agreements
Also effective October 1, 2026, noncompete agreements between licensed architects and certain employers are void and unenforceable.

Employers should review manager training, workplace communications, required postings, and restrictive covenant agreements to ensure compliance with these new requirements.
