Oklahoma has amended its medical marijuana law to provide additional clarity regarding workplace drug policies and safety-sensitive positions.
What Changed?
Beginning November 1, 2026:
Employers may maintain zero-tolerance drug and alcohol policies for employees in qualifying safety-sensitive positions.
The definition of safety-sensitive positions has been revised to remove an employer's discretion to designate positions and instead limit the definition to positions specified by law.
The law also clarifies when an employer may refuse to hire, discipline, discharge, or otherwise take adverse employment action based on a positive marijuana drug test.
