Nebraska Paid Sick Leave – Notice and Leave Requirements

Effective: September 15, 2025
Under the Nebraska Healthy Families and Workplaces Act (Initiative 436, as amended by LB 415), new employer requirements take effect in 2025:
Written Notice Requirement:
Employers must provide a written notice to employees by September 15, 2025, or at the time of hire, whichever is later.
Employers must also display a poster in the workplace. While the law does not specify a posting date, the conservative approach is to post as soon as it becomes available from the state.
Employer Coverage:
Applies to employers with 11 or more employees in Nebraska. Employers with fewer than 11 employees are exempt.
Employee Eligibility:
Employees under age 16, certain agricultural workers, independent contractors, and railroad workers are excluded.
Paid Sick Leave Accrual and Usage:
Beginning October 1, 2025, eligible employees accrue 1 hour of paid sick leave for every 30 hours worked after completing 80 consecutive work hours.
Employers with 11–19 employees must provide up to 40 hours per year.
Employers with 20 or more employees must provide up to 56 hours per year.
Accrued time can carry over, but annual use may be capped.
Employers are not required to pay out unused sick leave upon separation.
Employers with existing PTO policies that meet or exceed these requirements are deemed compliant.
Enforcement:
The Nebraska Department of Labor will enforce compliance. Employees do not have a private right of action under this law.
