Colorado Expands Noncompete Ban to Nurses and Dentists

Effective: August 9, 2025
Colorado has expanded its ban on noncompete agreements. Previously limited to physicians, the law now applies to:
Advanced Practice Registered Nurses (APRNs)
Licensed Dentists
Certified Midwives
These professionals may no longer be restricted by noncompete clauses under most circumstances, aligning with Colorado’s broader trend of protecting worker mobility and access to care.
The updated legislation, CO S.B. 83 (2025), went into effect on August 9, 2025, and amends the original statute to include all individuals “licensed to engage in the practice of medicine, advanced practice registered nursing, or dentistry,” as well as those “certified to practice as a certified midwife.”
Why It Matters:
Healthcare employers should work with their HRBP to review offer letters, employment agreements, and separation agreements for any language that may now be unenforceable.
This law is part of Colorado's broader movement to limit restrictive covenants that hinder career mobility, especially in high-demand sectors like healthcare.
Employers should consider alternative ways to protect proprietary information (e.g., non-solicitation clauses, confidentiality agreements) that are still legally enforceable if properly drafted.
