Federal Legislative Watch 2026: EEOC Proposes Eliminating EEO-1 Reporting

Effective: Proposed Rule (Not Yet Effective)
On July 23, 2026, the Equal Employment Opportunity Commission (EEOC) published a proposed rule that would eliminate federal EEO-1 reporting and related recordkeeping requirements. The proposal would also eliminate EEO-2 through EEO-6 reporting requirements.
What Employers Need to Know
At this time, no changes are required. Because the rule is only a proposal, employers should continue preparing for 2025 EEO-1 reporting until additional guidance is issued.
It remains unclear whether the final rule, if adopted, would eliminate the upcoming 2025 EEO-1 filing requirement or apply only to future reporting years.
Why This Matters
Many employers are currently collecting workforce demographic data for their annual EEO-1 submission. Discontinuing those efforts now could create compliance issues if the reporting requirement remains in effect for 2025.
Who Must File an EEO-1 Report?
Generally, private employers with 100 or more employees, and certain federal contractors with 50 or more employees that meet applicable contract and reporting requirements, are required to file an annual EEO-1 report summarizing workforce demographic data by job category, race/ethnicity, and sex.
