Colorado Regulatory Watch: CDLE Seeking Feedback on Proposed Unemployment Regulations

Possible Effective Date: January 2027

The Colorado Department of Labor and Employment (CDLE) has released proposed unemployment insurance regulation changes that could take effect in January 2027.


One proposal would clarify when employers may be deemed to have a "pattern of failing to respond" to unemployment claim information requests. The proposal establishes standards for timely and adequate responses and outlines when employers may be held responsible for improper benefit payments resulting from repeated failures to respond.


CDLE has indicated stakeholder meetings are expected in August, followed by a formal rulemaking hearing.


Employers that regularly manage unemployment claims may wish to review the proposals and participate in the stakeholder process if they have feedback or concerns.
