Illinois Clarifies Secure Choice Retirement Savings Enrollment Rules

Effective: January 14, 2026
Illinois has clarified employer enrollment requirements under the Secure Choice Retirement Savings Program.
Beginning January 14, 2026, employers must automatically enroll eligible employees who:
Are 18 years of age or older
Earn Illinois wages
Have been employed for 120 days
New employees must be enrolled as soon as practicable, but no later than 120 days after their employment start date.
What this means for employers
Automatic enrollment is required once an employee meets the age, wage, and service criteria.
Employers must closely track employee start dates and eligibility timelines.
Payroll and onboarding processes should be reviewed to ensure timely enrollment and compliance.
Action Recommended
Illinois employers should audit onboarding workflows, payroll systems, and eligibility tracking to confirm Secure Choice enrollment occurs within the required 120-day timeframe.
