Washington Expands Unemployment Benefits to Certain Striking Workers - HR ALERTS

Washington Expands Unemployment Benefits to Certain Striking Workers

Effective:  January 1, 2026

Washington has repealed prior restrictions on unemployment benefits for employees engaged in labor strikes.

Effective January 1, 2026, certain striking workers may now be eligible to receive unemployment benefits during a strike. This change represents a shift from prior law, which generally limited or prohibited benefit eligibility for workers involved in labor disputes.

What this means for employers

  • Employees participating in qualifying strikes may be eligible for unemployment benefits beginning in 2026.

  • Eligibility is not automatic and will depend on the circumstances of the strike and applicable state rules.

  • Employers should be aware that unemployment claims may arise even when a work stoppage is strike-related.

  • This change may affect labor planning, dispute strategy, and cost considerations during labor actions.

Action Recommended

Washington employers, particularly those with unionized workforces, should review labor relations strategies and consult with counsel as needed to understand how this change may impact strike-related planning.
