
Minnesota Independent Contractor Test
Effective: March 1st, 2025
Effective March 1st, Minnesota law will consider a worker as an independent contractor if they are operating as a business entity that meets certain requirements at the time services are provided or performed. This applies to contactors performing building construction or improvement services, fields where it can be complicated to define someone as an employee or a contractor.

It is important to note that, while this refers to state requirements, the Department of Labor also has a test for determining independent contractor status under the Fair Labor Standards Act (FLSA), which must also be considered.
