New Jersey Expands Job Protection and Leave Coordination Rules

Effective Date: July 17, 2026
New Jersey has amended its Paid Family Leave (PFL) and Temporary Disability Benefits (TDB) laws to strengthen job protections and clarify how leave benefits may be used.
thaBeginning July 17, 2026, employees taking PFL or TDB must be restored to their original position or an equivalent role upon return from leave.
What This Means
Employees are entitled to reinstatement to the same or equivalent position after PFL or TDB
Employees retain layoff and recall rights as if they had not taken leave
Leave Coordination Updates
Employees may choose whether to use paid sick leave, PFL, or TDB, and in what order
Employees may not receive multiple types of paid leave at the same time
Why It Matters
These changes strengthen employee protections and increase flexibility in how leave is used. Employers should ensure policies and practices align with these updated requirements.
What Employers Should Do
Update leave policies to reflect reinstatement requirements
Review coordination of paid sick leave, PFL, and TDB benefits
Train HR and managers on employee rights and leave sequencing
Ensure consistent tracking of leave usage and return-to-work processes
