Colorado Clarifies Protections for Chosen Names and Pronouns in the Workplace

Effective: Immediately (May 16, 2025)
Colorado has enacted House Bill 1312, which expands the definition of gender expression under the Colorado Anti-Discrimination Act to include:
An employee’s chosen name, and
The way they choose to be addressed, including pronouns.
This means that:
Deadnaming (using a person’s non-chosen or former name) and
Misgendering (using incorrect pronouns or forms of address)
The law applies to employers of all sizes and reinforces expectations around identity-affirming conduct in the workplace.
