DHS Ends Automatic Extensions of Noncitizen Work Permits

Effective: Immediately
Effective immediately, The Department of Homeland Security (DHS) has announced on October 30, 2025, that it will no longer automatically extend most work permits (Employment Authorization Documents) for noncitizens.
This change applies to individuals who file renewal applications on or after October 30, 2025 and do not qualify for one of the few remaining automatic extension categories.
What Employers Should Know:
Noncitizen employees should file renewal applications as early as possible, as processing times can take several months.
Without the automatic extension, work authorization may lapse between the expiration of the current document and DHS approval of the renewal.
Employers must reverify Form I-9 employment authorization once a previously valid document expires.
This change was published as an interim final rule by DHS on October 30, 2025.
