US Department of Labor (DOL) Keeps Subminimum Wages for Workers with Disabilities

Effective: July 3, 2025
As of July 3, 2025, the US Department of Labor (DOL) has announced it will no longer pursue a plan to phase out subminimum wages for workers with disabilities.
Under the Fair Labor Standards Act (FLSA), employers may continue to apply for special “14(c) certificates,” which allow them to pay workers with disabilities at rates below the federal minimum wage if their disabilities impact their earning or productive capacity.
A proposal to end this practice was made during the prior administration, with the goal of stopping new certificates and phasing out existing ones over three years. The DOL has now withdrawn that proposal, stating it lacks the statutory authority to permanently discontinue the program.
