Effective*: September 4th, 2024
The Federal Trade Commission (FTC) announced a final rule that would ban almost all noncompete clauses. This nationwide ban would not only ban new noncompete clauses, but also void existing noncompete clauses, with the exception of those for senior executives. Employers would also be required to provide written notice to all affected workers.
This ruling is supposed to go into effect on September 4th, 2024.*
*While employers should prepare for this to go into effect, there will likely be many legal challenges to this rule before said effective date, which could potentially alter the effective date or details of the final ruling. Employers should keep up on any news regarding this ruling, especially as the effective date draws nearer.
