Health Insurance Marketplace Notice
Among all of the new hire requirements that employers must comply with, the Health Insurance Marketplace Notice required by the Affordable Care Act (ACA) since 2013 for employers covered under the Fair Labor Standards Act (FLSA), is one that often falls through the cracks.
The Health Insurance Marketplace Notice must be provided to new employees within 14 days of their hire date. The easiest way to comply with this requirement is to provide the notice during the Onboarding process.
The Department of Labor (DOL) offers two sample or model versions of the notice that employers can use to meet this requirement: one for employers that offer a health plan to some or all employees, and another for employers that do not offer a health plan to any employees.
As of December 2023, the model notice on the DOL website has been updated; the newest versions are effective through December 31, 2026.
