Texas Prohibits Intentional AI Discrimination

Effective: January 1, 2026
Beginning January 1, 2026, the Texas Responsible AI Governance Act (TRAIGA) will prohibit the development or use of an artificial intelligence (AI) system with the intent to discriminate against a protected class in violation of federal or state law.
Under this law, disparate impact alone is not enough to show intent to discriminate, there must be evidence of intentional use or design for discriminatory purposes.
