Utah Service Members' Civil Relief Act 2024 | Utah Military Protections

HR Alerts : Vida HR Knowledge Center
Effective: March 18th, 2024

As of March 18th, 2024, Utah has enacted expanded military protections (Utah Service Members' Civil Relief Act). This requires all employers to provide five years of military leave for employees who are part of the reserves for the Armed Forces and called to active duty or training (for either active or inactive duty).

In addition, employees part of the Utah National Guard or State Defense Force are required to have the same rights and protections provided to employees who are called to federal military service. Finally, employees called to service must have their jobs restored at the end of service, with the same rate of pay, status, and any other benefits entitled under the Uniformed Services Employment and Reemployment Rights (USERRA).

Employers may want to consider adding a policy explaining the new leave they can take and the protections it comes with. If you are a Vida HR client, you can ask your HR Business Partner for more information. To review the full law, you can find it here.
