Arkansas Permits Disclosure of Sexual Harassment Findings to Prospective Employers

Effective: August 4, 2025
Effective August 4, 2025 under AR H.B. 1643, Arkansas expands the types of employment information an employer may disclose — with the employee’s written consent — to a prospective employer.
Specifically, the law permits disclosure of:
Substantiated allegations of sexual abuse or sexual harassment by the employee.
The employee’s resignation during a pending investigation of such allegations.
Action Steps:
Work with your Vida HR HR Business Partner (HRBP) to ensure reference-check and disclosure procedures are updated.
Coordinate with your Vida HR team before providing any employee disclosures to ensure written consent is properly obtained.
Make sure your managers are informed of the law’s requirements and know to route any related requests or issues through Vida HR.
