Colorado Clarifies Job Protection Rules Under FAMLI Leave

Effective: August 4, 2025
Effective July 1, 2025, the Colorado Department of Labor and Employment has adopted new rules clarifying when job protection applies under the state’s Paid Family and Medical Leave Insurance (FAMLI) program.
Key Update: Employment Tenure Required for Job Protection
These clarifications, issued under CCR 1107-7, resolve confusion around when employers must reinstate employees following FAMLI-covered leave.

Type of FAMLI Leave | Job Protection Applies When… |
Continuous Leave | Employee has been employed for at least 180 days before the leave begins. |
Intermittent Leave | Employee reaches 180 days of employment, even if that occurs during the leave period. |
