Colorado Announces Updated Workers’ Compensation Benefit Maximums for 2025–2026

Effective: July 1, 2025 – June 30, 2026

 

On June 6th , the Colorado Division of Workers’ Compensation has released the 2025 Maximum Benefits Order, adjusting workers’ compensation benefit rates based on the updated state average weekly wage. These changes impact how much injured employees may receive in wage replacement, lump sum settlements, disfigurement claims, and death benefits.

 

Key 2025–2026 Rates and Limits


State Average Weekly Wage:

$1,534.94

Maximum Weekly Compensation Rate:

$1,396.85 (91% of SAWW)

To qualify, the injured employee must earn at least $2,095.27 per week

Scheduled Impairment Weekly Rate:

$438.33

Non-Scheduled (Medical) Impairment:

$150.00 to $767.47 per week

Disfigurement Maximums:

Standard: $7,394.64

Extensive (facial/body scars, stumps, burns): $14,786.65

Lump Sum Maximums:

Individual/Sole Dependent: $128,851.00

Multiple Dependents (aggregate): $257,698.76

Combined Cap for TTD + PPD:

19% or less whole person impairment: $192,996.79

20% or greater whole person impairment: $312,967.77

Threshold to Terminate Permanent Total Disability:

$9,039.14 in annual earnings

Death Benefits:

Maximum weekly benefit: $1,396.85

Minimum: $349.21

Funeral/burial expenses: up to $14,206.62

No dependents: $29,461.68 paid to the Colorado Uninsured Employer Fund
