Louisiana Expands Employee Workplace Protections 2026

Effective Date: August 1, 2026
Louisiana enacted several new employment laws that expand employee protections related to leave, workplace safety, and restrictive covenants.
What Changed?
Organ and Bone Marrow Donor Leave
Private employers with one or more employees must provide eligible employees with up to 30 consecutive calendar days of unpaid leave to donate an organ or bone marrow.
Behind the Counter Protection Act
The new law strengthens protections against workplace violence for employees who regularly interact with customers at points of transaction, such as checkout counters, service desks, and drive-through windows. Employers may display state-issued signage warning that workplace violence is a crime under Louisiana law.
Noncompete Agreements
Beginning August 1, employers may no longer require interns or apprentices to sign noncompete agreements. These individuals may still be subject to confidentiality, intellectual property, and data protection agreements.
Why This Matters
Louisiana employers should review leave policies, workplace violence prevention practices, and restrictive covenant agreements to ensure compliance with these new requirements.
Recommended Next Steps
Update leave policies to address organ and bone marrow donor leave.
Review noncompete agreement templates for interns and apprentices.
Evaluate workplace violence prevention measures for customer-facing employees.
