Montana Enacts New Employment Verification Law Effective July 1, 2025

Effective: July 1, 2025
Montana has enacted the Legal Employment and Government Accountability Law (MT H.B. 226), which imposes new employment verification requirements for all Montana employers.
Beginning July 1, 2025, employers must request and retain one of the following for every employee for three years after the date of hire or one year after employment ends, whichever is later:
Verification of citizenship or work authorization status through the E-Verify system, or
A completed Form I-9 along with supporting documents that confirm both identity and employment authorization.
The law also establishes civil penalties for failure to comply.
