QUESTION:

I discovered that one of my employees used AI to complete their work, instead of doing it themselves! I don’t trust AI and I don’t like that my employee used it. Can I terminate an employee for using AI to complete their work?

Well, the answer that you are probably dreading getting is…it depends.

Do you have a written policy stating your business’ stance on the use of AI? Have you communicated your written policy to your employees and obtained an acknowledgement from your employees indicating their understanding of the policy?

If so, you may be within your rights to make an employment decision.

If not, you may want to consider whether or not you should terminate employment with the individual because they did not know your business prohibits the use of AI. Using AI does have it’s advantages, but there are also cons to using it.

You may be considering the risks to your business if an employee is using AI to complete their work:

  • Is the information accurate?

  • Is there any way to know if the content is plagiarized?

  • Did your employee include confidential information about your Company, like trade secrets when using AI?

  • Does the employee’s use of AI put your company at risk for a lawsuit?

There are currently no laws restricting AI usage. It is highly recommended that your business have an AI policy in your handbook that clearly explains what employees can and cannot use AI for, if at all on the job, and include information about consequences for violating the policy.

I am the Partner, VP of Sales at Vida HR! My professional journey started 37 years ago when I began selling books door-to-door with the Southwestern Company. Within my second year, I transitioned into a Sales Manager role, a position I've been happily serving in ever since, fostering sales growth and building successful teams. I find great fulfillment in meeting new people and exploring ways to provide them with long-term solutions. From early on, I learned that by helping clients and empowering my team to succeed, I also achieve success. I'm humbled and grateful that this approach has enabled me to cultivate enduring relationships with clients throughout my career.

My Predictive Index Profile is “Maverick” which means I've been blessed, or perhaps cursed depending on who you ask, with a high level of energy, proactiveness, and optimism, qualities that have served our company well.

A little about me:

I've lived in 19 states, resided in 50 houses, and traveled to 32 countries, so you could say I'm from "all over." This diverse exposure to different places, people, and cultures has shaped my perspective and instilled in me a deep appreciation for various viewpoints. Additionally, I'm immensely enthusiastic about the delicious foods I've encountered during my travels. Being an avid outdoorsman, I enjoy activities such as skiing, fly fishing, camping, biking, surfing behind our boat, and simply being in nature. My passion for the outdoors began in childhood when my dad introduced me to the adventures of Colorado. Consequently, as soon as I could, I made Colorado my home, moving here with my wife over 30 years ago.
 

Thirty years ago, I married the love of my life, Kelly, and together we have three adult children who reside here in Fort Collins. Our family bond is strong, and we enjoy engaging in outdoor adventures together. We purposefully participate in activities our children enjoy, ensuring our family continues to have fun together for years to come. Kelly has made significant strides in growing a non-profit organization called Life for the Innocent, which aids children rescued from human trafficking across Asia. I'm honored to serve on the board of directors for this organization, which has facilitated over 30,000 adoptions into forever families. Once again, I believe I've married above my station. Kelly and I share a passion for travel and eagerly anticipate exploring many more countries together.
